1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement and, if you're under the age of majority in your jurisdiction, that a parent or guardian has reviewed and agreed to these Terms on your behalf.

2. Accounts

You need an account to record or view attempts. You're responsible for the activity on your account and for keeping your login credentials secure. Provide accurate information when you sign up, and let us know at the email below if you believe your account has been compromised.

3. The Service

Onlyest lets users invent arbitrary, measurable feats ("titles"), record a video attempt in-app, and submit it for automated grading. If your attempt passes grading, you become the title's current holder (or, if it's a new title, its inventor) and a highlight clip of your attempt is published publicly. Other users can then attempt to beat your score to take over the title ("dethroning" you). A few mechanics worth knowing going in:

• Any strictly better score dethrones the current holder— there's no minimum margin you need to beat a record by.
• Attempts are capped at 90 seconds of recorded video.
• If you fail a contest attempt, you must wait 15 minutes before attempting the same title again.
• Grading is a pre-publish gate: nothing about a failed attempt is made public. Only your own account can see that you attempted and failed.
• In-app recording only. Onlyest does not accept video uploaded from your camera roll — only footage recorded live in the app.

Onlyest is not affiliated with, endorsed by, or a substitute for any official record-keeping organization. "Titles" and "records" on Onlyest are community-generated and community-graded — they carry no formal certification or verification beyond what's described in these Terms.

4. AI Grading

Attempts are graded automatically using a third-party AI model (see our Privacy Policy for how your video is processed). Automated grading can be wrong — it may pass an attempt that shouldn't have passed, or fail one that should have. Grading decisions are not guaranteed to be accurate, consistent, or free of error.

If you believe a grading decision on your own attempt, or on a title you hold, was incorrect, you can file a dispute in-app. Filing a dispute marks the title "Contested" pending review. Dispute resolution in the current version of the Service is handled manually by Onlyest and is not guaranteed within any particular timeframe. We may uphold the existing result, reverse it, or remove the title or attempt entirely, at our discretion.

5. Your Content

You retain ownership of the videos and other content you submit. By submitting an attempt, you grant Onlyest a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and — if the attempt passes grading — publicly display and distribute the resulting highlight clip as part of the Service (e.g. on title pages, leaderboards, and profiles), for as long as the associated title record exists or your account remains active.

You're responsible for what you record. By submitting an attempt, you represent that:

• You have the right to share the video, and the necessary consent from anyone else identifiable in it.
• The attempt is genuine — not staged to deceive the grading system, digitally manipulated, or otherwise misrepresented.
• It doesn't depict anything illegal, or dangerous in a way intended to encourage others to cause themselves or others harm.

6. Prohibited Conduct

You agree not to:

• Submit fraudulent, staged, or manipulated attempts to obtain a title dishonestly.
• Harass, impersonate, or infringe the rights of others.
• Attempt to interfere with, reverse-engineer, or abuse the Service or its grading system.
• Use the Service for anything illegal, or to record or share content that is illegal, sexually explicit, or that endangers minors.
• Create multiple accounts to evade a cooldown, ban, or other restriction.

7. Disputes Over Titles

Filing a dispute (see "AI Grading" above) is the mechanism for challenging a grading decision or a title's legitimacy. It is not a guarantee of any particular outcome or timeline. Repeated bad-faith disputes may themselves be treated as prohibited conduct.

8. Intellectual Property

Onlyest's branding, app, badge/sticker artwork, and other elements of the Service (excluding your own content) are owned by Onlyest or its licensors and protected by applicable intellectual property laws. These Terms don't grant you any rights to use Onlyest's branding or IP outside of normal use of the Service.

9. Third-Party Services

The Service relies on third-party providers (Supabase, Google's Gemini API, Google/Apple/Facebook sign-in, Google Analytics) described in our Privacy Policy. Your use of features that involve those providers (e.g. signing in with Google) is also subject to that provider's own terms.

10. Termination

You can delete your account at any time by contacting us at the email below. We may suspend or terminate your account if you violate these Terms, and may remove content or titles that violate these Terms or that we determine, in our discretion, are unsafe or fraudulent.

11. Disclaimers

THE SERVICE, INCLUDING AI GRADING RESULTS, IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GRADING DECISIONS WILL BE ACCURATE.

Physical activity disclaimer: many titles involve physical feats. You attempt them at your own risk. Onlyest is not responsible for any injury or harm resulting from attempting a title.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONLYEST WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. IN NO EVENT WILL ONLYEST'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE EXCEED ONE HUNDRED DOLLARS ($100).

13. Indemnification

You agree to indemnify and hold Onlyest harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you in-app. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law provisions.

16. Dispute Resolution and Arbitration

Any dispute arising out of or relating to these Terms or the Service will first be attempted to be resolved through good-faith negotiation between you and Onlyest. If that doesn't resolve the dispute within a reasonable time, it will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its rules, rather than in court — except that either party may bring an individual claim in small claims court where eligible. YOU AND ONLYEST EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION OR CLASS ARBITRATION; disputes must be brought individually.

17. Severability

If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will stay in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Onlyest regarding the Service, and supersede any prior agreements on the same subject.
